Age Restrictions Each state and many localities have different smoking laws. No retailer may sell cigarettes or smokeless tobacco to any person younger than 18 years of age. It is also illegal to attempt to purchase tobacco (even if unsuccessful) under the age of 18, but, depending on state law, it may or may not be illegal for a person under 18 to use tobacco products. When a customer appears to be under a specific age, state and local laws may require retailers to verify age by means of photographic identification. In addition, the tobacco purchase age has been raised to 19 in Alabama, Alaska, New Jersey, and Utah. Although the federal government has made the minimum age for purchasing tobacco to be 18, any state that is below that minimum age of 18 gets grants withheld from FEMA whenever a natural disaster occurs in their jurisdiction.
